Terms and Conditions

Welcome to DSC Designs Web Designs ("DSC Designs", "we", "our", or "us"). These Terms and Conditions govern the use of our website and the provision of our services. By using our website or engaging our services, you agree to be bound by these Terms and Conditions.


1. Company Information

DSC Designs is a South African web design and digital services business providing, amongst other services:

  • Website Design and Development

  • Website Hosting

  • Domain Registration

  • Business Email Setup

  • Website Maintenance

  • Search Engine Optimisation (SEO)

  • Graphic Design

  • Digital Marketing

  • Technical Consulting


2. Acceptance of Terms

By requesting a quotation, accepting a proposal, making payment, or using any of our services, you agree to these Terms and Conditions.


3. Quotations

All quotations:

  • are valid for 30 calendar days unless otherwise stated;

  • exclude additional work not specifically listed;

  • may change if the project scope changes.


4. Payments

Unless agreed otherwise in writing:

  • 50% deposit before work commences.

  • Remaining balance payable before the website goes live.

  • Monthly services are payable in advance.

  • Invoices are payable within 7 days.

Late payments may result in suspension of services.


5. Website Ownership

Ownership of the completed website transfers to the client only after full payment has been received.

Until payment has been received in full:

  • all designs;

  • source files;

  • graphics;

  • website code;

remain the intellectual property of DSC Designs.


6. Domain Registration

Where DSC Designs registers a domain on behalf of a client:

  • the domain is registered in the client's name wherever possible;

  • renewal fees remain the client's responsibility;

  • failure to renew may result in loss of the domain name.

DSC Designs cannot be held responsible for expired domains where renewal invoices were not paid.


7. Website Hosting

Where hosting is supplied:

  • reasonable uptime will be maintained;

  • scheduled maintenance may occasionally interrupt service;

  • emergency maintenance may occur without prior notice.

DSC Designs is not liable for outages caused by:

  • data centres;

  • Internet Service Providers;

  • third-party software;

  • cyber attacks;

  • force majeure events.


8. Client Responsibilities

The client agrees to provide:

  • accurate information;

  • branding material;

  • logos;

  • photographs;

  • written content;

  • approvals;

within reasonable timeframes.

Project delays caused by missing information may affect delivery dates.


9. Project Changes

Minor revisions are included where agreed.

Additional work outside the original scope will be quoted separately.


10. Content

The client warrants that all supplied content:

  • belongs to them, or

  • they have permission to use it.

The client indemnifies DSC Designs against any copyright, trademark or intellectual property claims relating to supplied content.


11. Intellectual Property

Unless otherwise agreed:

  • custom coding remains licensed to the client;

  • third-party software remains subject to its own licence;

  • WordPress themes and plugins remain governed by their respective licence agreements.


12. Search Engine Optimisation

While DSC Designs follows accepted SEO best practices, we cannot guarantee:

  • Google rankings;

  • search engine placement;

  • website traffic;

  • sales;

  • enquiries.

Search engine algorithms are outside our control.


13. Website Maintenance

Maintenance packages cover only the services included in the selected plan.

Emergency work or work outside the agreed package may incur additional charges.


14. Backups

Where backups form part of the hosting package:

  • backups are performed regularly;

  • restoration is subject to the availability of backup files.

Clients are encouraged to retain their own copies of important website data.


15. Third-Party Services

DSC Designs may integrate services including:

  • Google

  • Microsoft

  • Cloudflare

  • WordPress Plugins

  • Payment Gateways

  • Social Media Platforms

We are not responsible for outages, policy changes, pricing changes, or discontinued services provided by third parties.


16. Limitation of Liability

To the maximum extent permitted under South African law, DSC Designs shall not be liable for:

  • loss of profits;

  • indirect damages;

  • consequential damages;

  • business interruption;

  • data loss;

  • reputational damage.

Our total liability shall not exceed the amount paid by the client for the affected service.


17. Confidentiality

Both parties agree to treat confidential business information as confidential and not disclose such information except where required by law.


18. POPIA Compliance

DSC Designs processes personal information in accordance with the Protection of Personal Information Act, 4 of 2013 (POPIA).

Personal information will only be collected where necessary to provide our services and will not be sold to third parties.

19. Consumer Protection Act

Where applicable, these Terms are subject to the Consumer Protection Act 68 of 2008.

Nothing contained in these Terms excludes any rights afforded to consumers under South African law.


20. Electronic Communications

By communicating with DSC Designs electronically, you consent to receiving communications electronically for contractual and operational purposes.


21. Cancellation

Either party may terminate monthly services by giving 30 calendar days' written notice.

Outstanding invoices remain payable.

No refunds will be issued for:

  • completed work;

  • domain registrations;

  • software licences;

  • hosting already paid for;

  • third-party services already purchased.


22. Suspension of Services

DSC Designs reserves the right to suspend services where:

  • invoices remain unpaid;

  • illegal activity is detected;

  • hosting resources are abused;

  • these Terms are breached.


23. Force Majeure

Neither party shall be liable for delays or failures caused by events beyond reasonable control, including:

  • natural disasters;

  • power failures;

  • internet outages;

  • war;

  • civil unrest;

  • pandemics;

  • government action.


24. Governing Law

These Terms shall be governed by the laws of the Republic of South Africa.

Any disputes shall be subject to the jurisdiction of the South African courts.


25. Changes to these Terms

DSC Designs reserves the right to amend these Terms from time to time.

Updated Terms will be published on this website with a revised effective date.
